• Welcome to Delmarva Disposal LLC! These Terms of Service (“Terms”) govern the use of our residential trash disposal services. By subscribing to our services, you agree to comply with and be bound by these Terms.

2. Service Overview

• Delmarva Disposal LLC provides residential trash pickup services, including one 96-gallon trash can per subscription. Our service options include weekly, monthly, and yearly plans.
• Recycling services are also available, and customers will receive one 96-gallon recycling bin per service. If additional bins are required, extra charges will apply.

3. Fees, Pricing & Adjustments

• Service fees are as listed or contracted at checkout on our website.
• Delmarva Disposal LLC reserves the right to adjust pricing due to:
  • Increased dump fees
  • Excessive trash volume or additional cans at the service location
  • Additional services requested
• Delmarva Disposal LLC reserves the right to change prices at any time for any reason, including but not limited to changes in operating costs, market conditions, or service requirements.
• Customers will be notified of any price changes in advance.

4. Refund Policy

• Delmarva Disposal LLC reserves the right to not issue any refund under any circumstances, including but not limited to:
  • Failure to comply with service terms or waste disposal guidelines
  • Service interruptions outside of our control (e.g., weather, emergencies)
  • Failure to return the bin in acceptable condition
  • Cancellation of services after a payment has been processed
  • Unacceptable or hazardous materials placed in the bin
  • Any other violations of the Terms of Service
• Refunds, if issued, will be processed within [specific timeframe, e.g., 30 days] after review.

5. Deposit Refund Policy

• The $50 deposit for the garbage bin is refundable only if the bin is returned in its original condition, undamaged and clean.
• Delmarva Disposal LLC reserves the right to not issue any refund for the deposit under any circumstances, including but not limited to:
  • Failure to return the bin in acceptable condition
  • Bin lost, damaged, or excessively worn
  • Any violation of the Terms of Service or Waste Disposal Guidelines
• Refunds, if issued, will be processed within [specific timeframe, e.g., 30 days] after the bin is returned and inspected.

6. Customer Responsibilities

• Proper Use: Customers must use the garbage bin in accordance with the provided guidelines and not place prohibited items in it.
• Bin Placement: The bin should be placed in an accessible location for regular pickup. If special arrangements are needed (e.g., pickup closer to the house), please contact us in advance.

7. Prohibited and Hazardous Materials

• Customers must not place hazardous or prohibited materials in the trash bin, including but not limited to:
  • Flammable, toxic, or corrosive materials
  • Electronics, batteries, or appliances
  • Paint, solvents, or chemicals
  • Medical waste or needles
  • Any other materials as listed in the Waste Disposal Guidelines
• Should hazardous materials or items requiring special disposal be found in the trash bin, Delmarva Disposal LLC reserves the right to assess an additional fee to cover the cost of proper disposal.
• Customers are responsible for ensuring that only accepted materials are placed in the trash bin. For more details, please refer to our Waste Disposal Guidelines.

8. Chargeback & Payment Disputes

By subscribing to our services, the customer agrees to pay all fees as listed at checkout or in their contract. Customers waive their right to dispute payments or request chargebacks for services that have already been provided.

In the event of a chargeback, Delmarva Disposal LLC reserves the right to:

• Pursue legal action to recover the disputed amount, including legal fees and collection costs.
• Terminate service immediately without notice.
• Report unpaid balances to credit agencies and debt collection services.

Any attempted chargebacks will result in immediate termination of service and may result in additional fees for the time and costs associated with resolving the dispute.

9. Right to Refuse or Cancel Service

• Delmarva Disposal LLC reserves the right to refuse service or cancel any subscription at any time, for any reason, including but not limited to:
  • Failure to comply with these Terms
  • Non-payment of fees or outstanding balances
  • Disruptive or abusive behavior
  • Repeated violations of waste disposal guidelines
• Upon cancellation of services, customers must immediately return the garbage bin in good condition or be charged for the full cost of replacement.

10. Limitation of Liability

• Delmarva Disposal LLC is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the extent permitted by law.
• Delmarva Disposal LLC is also not responsible for trash not picked up if the bin is not properly placed out curbside, unless prior arrangements have been made for disabled or unable individuals.

11. Changes to Terms

• Delmarva Disposal LLC reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the revised Terms.
