Terms of Services


IMPORTANT: These Terms and Conditions constitute a legally binding agreement (the "Contract") between the customer ("you") and Delmarva Disposal LLC ("we," "us," or "our"). By signing up for service, making payment, or using our trash or recycling services, you agree to be bound by all terms outlined in this document.

New customers who sign up for service on or after this date are subject to the revised terms, including updates regarding non-fixed pricing and fee adjustments.

1. Introduction

Welcome to Delmarva Disposal LLC! These Terms of Service (“Terms”) govern the use of our residential trash disposal services. By signing up and ordering our services, you agree to comply with and be bound by these Terms.

2. Service Overview

Delmarva Disposal LLC provides residential trash pickup services with reliable weekly curbside collection (4 pickups per month). Each subscription includes the use of a 96-gallon trash can, provided upon payment of a refundable deposit. Additional trash cans may be requested with an additional deposit. Our service options include weekly, monthly, and yearly plans.

For added convenience, customers may upgrade to valet service, where trash is collected closer to the home.

3. Fees, Pricing & Adjustments

All service fees are based on the rates shown at checkout or outlined in your service agreement. Pricing is not fixed or guaranteed and may be adjusted at the sole discretion of Delmarva Disposal LLC.

  • Delmarva Disposal LLC reserves the right to adjust pricing due to increased dump fees, additional trash volume, extra cans at the service location, requests for additional or special services, or changes in operational costs or market conditions.
  • Delmarva Disposal LLC may charge additional fees if a trash bin is determined to be overweight at the time of pickup, at the driver’s sole discretion. Repeated instances of overweight bins may result in permanent additional fees or require the customer to request additional bins to accommodate their waste volume.
  • Customers will be notified of pricing changes whenever possible. Continued use of services after notice constitutes acceptance of the new rates.

4. Refund Policy

Delmarva Disposal LLC strictly prohibits refunds once services have been performed. The company reserves the right, at its sole discretion, to deny any refund under any circumstances, including but not limited to:

  • Cancellation of services after payment has been processed or after services have been performed.
  • Failure to comply with service terms, waste disposal guidelines, or any other contractual obligations.
  • Service interruptions beyond Delmarva Disposal LLC’s control (e.g., weather, emergencies, holidays).
  • Failure to return the bin in acceptable condition or as required under the Deposit Refund Policy.
  • Placement of prohibited, hazardous, or otherwise unacceptable materials in the bin.
  • Any other violation of the Terms of Service.

Refunds, if issued, are at the sole discretion of Delmarva Disposal LLC and will be processed within 30 days following a review of the request.

5. Deposit Refund Policy

The $50 deposit for the garbage bin is refundable only if the bin is returned in its original condition, undamaged, and reasonably clean.

Delmarva Disposal LLC reserves the right to withhold or deny the deposit refund under any circumstances, including but not limited to:

  • Failure to return the bin in acceptable condition.
  • Bin lost, damaged, or excessively worn.
  • Bin returned excessively dirty, in which case a cleaning fee may apply.
  • Any violation of the Terms of Service or Waste Disposal Guidelines.

Refunds, if issued, will be processed within 30 days after the bin is returned and inspected.

6. Customer Responsibilities

  • Proper Use: Customers must use the garbage bin in accordance with all provided guidelines and may not place prohibited items inside.
  • Household-Only Use: The bin is assigned to the subscribing household only. Customers may not place other individuals’ or households’ trash in the bin.
  • Care of Bin: The bin is the property of Delmarva Disposal LLC. Customers must ensure it is not painted, altered, defaced, or otherwise modified.
  • Return of Bin: The bin must be returned to Delmarva Disposal LLC at the end of service in acceptable condition to be eligible for a deposit refund.
  • Bin Placement: The bin should be placed in an accessible location for regular pickup. If special arrangements are needed (e.g., valet service), customers must contact Delmarva Disposal LLC in advance.
  • Weight Limits: Customers are responsible for keeping trash within reasonable weight limits so that bins can be safely lifted and emptied.
  • Liability: Customers are responsible for any damage to the bin caused by misuse, neglect, or abuse.
  • Compliance: Customers must follow all service guidelines. Failure to comply may result in additional fees, service refusal, or termination of service.
  • Other Misuse: Any other misuse of the bin not listed herein is also the responsibility of the customer.

7. Prohibited Materials for Trash

Customers must not place hazardous or prohibited materials in the trash bin, including but not limited to:

  • Flammable, toxic, or corrosive materials
  • Electronics, batteries, or appliances
  • Paint, solvents, or chemicals
  • Medical waste or needles
  • Any other materials as listed in the Waste Disposal Guidelines.

Should hazardous materials or items requiring special disposal be found in the trash bin, Delmarva Disposal LLC reserves the right to assess an additional fee to cover the cost of proper disposal.

Customers are responsible for ensuring that only accepted materials are placed in the trash bin. For more details, please refer to our Waste Disposal Guidelines.

8. Prohibited Materials for Recycling

To ensure safe and effective recycling, customers must NOT place the following items in the recycling bin:

  • Plastic bags, film, or wrap (these can clog recycling machinery)
  • Food waste or liquids (contaminate recyclable materials)
  • Styrofoam or foam containers
  • Electronics, batteries, or appliances
  • Hazardous materials, chemicals, or paint
  • Greasy or soiled paper products (e.g., pizza boxes)
  • Non-recyclable plastics such as certain toys or utensils

If prohibited materials are found in your recycling bin, Delmarva Disposal LLC reserves the right to assess an additional fee to cover the cost of proper disposal and contamination cleanup.

9. Chargeback & Payment Disputes

By ordering our services, the customer agrees to pay all fees as listed at checkout, in their contract, or as outlined in the Terms of Service in effect at the time of purchase. Customers waive their right to dispute payments or request chargebacks for services that have already been provided.

In the event of a chargeback or payment dispute, Delmarva Disposal LLC reserves the right to:

  • Pursue legal action to recover the disputed amount, including legal fees and collection costs.
  • Terminate service immediately without notice.
  • Report unpaid balances to credit agencies and debt collection services.

Any attempted chargebacks or payment disputes for services already rendered will result in immediate termination of service and may incur additional fees to cover costs associated with resolving the dispute.

10. Right to Refuse or Cancel Service

Delmarva Disposal LLC reserves the right to refuse service or cancel any service at any time, for any reason, including but not limited to:

  • Failure to comply with these Terms of Service.
  • Non-payment of fees or outstanding balances.
  • Disruptive, abusive, or threatening behavior.
  • Repeated violations of waste disposal guidelines.

Upon cancellation of services, customers must immediately return the garbage bin in good condition or be charged for the full replacement cost.

11. Limitation of Liability

Delmarva Disposal LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of its services, to the fullest extent permitted by law.

Customers are solely responsible for proper placement, loading, and use of the trash bin in accordance with all guidelines. Delmarva Disposal LLC is not responsible for damage to or caused by bins, including but not limited to bins damaged by weather, high winds, or accidents, or bins that fly away or cause property damage due to improper placement.

Delmarva Disposal LLC reserves the right to refuse service or not pick up trash at its sole discretion, including but not limited to bins that are overloaded, contain prohibited or hazardous materials, or have bulky items obstructing collection. Customers are responsible for compliance with all service requirements, and prior arrangements must be made for disabled or unable individuals when curbside placement is not feasible.

12. Changes to Terms

Delmarva Disposal LLC reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the revised Terms.

Addendum: Revised Terms and Conditions

Effective Date: May 28, 2025

This addendum serves as an update to Delmarva Disposal LLC's existing Terms and Conditions. It applies to all new customers who sign up for service on or after May 28, 2025. By initiating service, you agree to the terms outlined below in addition to all previously stated conditions.

Pricing and Fee Adjustments

  • Effective May 28, 2025, all service rates—including monthly, quarterly, and yearly pricing—are not guaranteed or fixed and are subject to change based on increases in operational costs, such as landfill dump fees, fuel prices, and other disposal-related expenses.
  • In the event of a rate increase during an active quarterly or yearly billing period, Delmarva Disposal LLC reserves the right to issue an adjustment invoice to collect the balance owed for the increased service rate.
  • Customers will be notified of any price changes in advance, and the adjustment invoice must be paid in accordance with the regular payment terms.
  • Delmarva Disposal LLC may charge an additional fee if a trash bin is determined to be overweight at the time of pickup, at the driver’s sole discretion.
  • Repeated instances of overweight bins may result in permanent additional fees or require the customer to request additional bins to accommodate their waste volume.
